Landlords: Ready For New Challenges In 2019?

A New Year brings new challenges and landlords should be prepared for new regulations and fresh obstacles. At Jezzards, we aim to provide local landlords with as much support as we can, and the following issues should all be considered as possible challenges in 2019.

Be aware that the letting fees ban may come into effect

Although there is no set date for when the ban on letting agents charging tenants fees will come into effect, it is believed that this will occur in 2019. The new regulations will see a number of changes for landlords including:

The deposit being capped at five weeks’ worth of rent

Landlords and agents not being able to charge for fees apart from in limited circumstances

With no due date, it is easy to see why some landlords are not concerning themselves with this change just yet but if you like to plan, it is worth being aware of.

There will be an increase in local licencing schemes

In 2019, it is believed that over 60 local councils in England will run selective or additional licencing schemes. Although there are HMO regulations coming into effect in 2019, the local licencing schemes will go further and can apply to all landlords.

Landlords may have to pay as much as £600 for a licence, and may be required to pass a “fit and proper test”.

Expect improvements in the rogue landlord database

While the rogue landlord database was launched in 2018, it isn’t operating in the way it was intended. However, it is believed that the database will become more populated in 2019 and that tenants will have access to the information.

This could create a change in local lettings markets and even if you are a landlord who operates within the law and isn’t concerned about being on the database, there may be an opportunity to gain new tenants or promote your own services as a trustworthy landlord.

Be aware of the minimum space requirements

The regulations impacting on the minimum size of bedrooms was introduced in October of 2018 but it is likely to be enforced this year. The regulations are as follows:

  • A single person who is under ten years old should be housed in a bedroom that is a minimum of 4.64 square metres
  • A single person who is over ten years old should be housed in a bedroom that is a minimum of 6.51 square metres
  • Two people who are both over ten years old should be housed in a bedroom that is a minimum of 10.22 square metres

Any landlord that fails to comply with this regulation will have 18 months to resolve the problem and if they don’t make the necessary changes, they will face a fine.
